Purchased a house with HOA infringement. The agreement expressed no liens/infringement against the house, yet when we moved in we saw the past proprietors infringement in our mail. The HOA estoppel didn't get documented before we purchased the house (estoppel was to be recorded by shutting organization). 


Quick version, one of the infringement was the fence needing substitution/expulsion (it's unrecoverable). New HOA rules says no wooden fence (this standard instituted prior to shutting), just expulsion (no fence) or new vinyl fence permitted. 


Our title protection is (probably) covering the check for fixes, but they need to simply eliminate the fence (I trust it is shared/co-possessed on each of the 3 sides). 


Do they have a commitment to cure the infringement with another fence, since we purchased the property with a current fence, or can they lawfully pull off bringing it down? I likewise comprehend that since it is co-claimed, it might get muddled with the neighbors. 


P.S. my neighbors are cool as hellfire and furthermore need another vinyl fence out of the arrangement, and are in any event, able to pay something reasonable. I be that as it may, don't have the money for it at the present time, and we likewise have canines.
